Reactive Medical – Terms and Conditions
Also trading as Eleven Forty One Adventures
1. Definitions
“Company” means Reactive Medical / Eleven 41.
“Client” means the individual or organisation ordering Services.
“Services” means all medical cover, training, expedition support, consultancy, or any other services supplied by the Company.
“Course” means any training event delivered by the Company.
“Event” means any activity, production, expedition, or gathering for which medical cover is provided.
“Consumables” means single‑use or disposable medical items used in the provision of care.
“FREC 3” means an Ofqual‑regulated Level 3 Certificate in First Response Emergency Care (RQF) or equivalent.
2. Scope of Services
2.1 The Company delivers workplace first aid training, expedition & outdoor first aid, event and expedition medical cover, consultancy, and associated services throughout the United Kingdom.
2.2 All Services are provided in accordance with current UK clinical guidelines, including but not limited to the Resuscitation Council UK Guidelines, Faculty of Pre‑Hospital Care (RCSEd) Guidance, and JRCALC UK Ambulance Service Clinical Practice Guidelines.
2.3 No deviation from these guidelines is permitted by Company personnel or course participants.
3. Medical Cover
3.1 Medical cover is provided on‑site only; patients are not transported from site by the Company. Where onward transport is required, the Company will request statutory NHS ambulance services or advise the Client to arrange alternative transport.
3.2 Medical cover will be staffed at a minimum of FREC 3 qualification (or higher where specified).
3.3 The Client must supply an accurate risk assessment and event‑specific information no later than 14 days before the Event.
3.4 Any consumables or equipment used on scene will be itemised and invoiced to the Client at cost plus a reasonable handling fee.
3.5 The Company carries appropriate professional indemnity and public liability insurance. Certificates are available on request.
4. Training Courses
4.1 Course places are confirmed only on receipt of a completed booking form and full payment or purchase order.
4.2 All participants must:
• complete the medical declaration provided;
• meet any pre‑course entry requirements;
• be physically able to take part in practical sessions conducted indoors and outdoors.
4.3 Participants are responsible for their own health, safety, and personal insurance.
4.4 Certification is awarded only upon successful completion of all assessments.
4.5 Adverse Weather: The Company reserves the right to cancel, curtail, or relocate a Course if adverse weather is expected, at the sole discretion of the Course Director, where conditions may compromise safety or learning outcomes.
5. Bookings, Cancellations & Rescheduling
5.1 Once a booking is confirmed, fees are non‑refundable.
5.2 If the Client or participant cannot attend, a single rebooking to an alternative date within 12 months will be offered, subject to availability and any price difference.
5.3 The Company may cancel or postpone Services for reasons including but not limited to adverse weather (see 4.5), staff illness, force majeure, or insufficient enrolment. In such cases the Client will be offered a new date or credit note; the Company’s liability is limited to fees already paid.
5.4 Transfers or substitutions of participants must be agreed in writing at least 48 hours before the Course.
6. Fees, Invoicing & Payment
6.1 All prices are exclusive of VAT unless stated otherwise.
6.2 Invoices, including those for consumables (see 3.4), are payable within 14 days of issue unless otherwise agreed in writing.
6.3 Late payments may incur interest at 8 % above the Bank of England base rate pursuant to the Late Payment of Commercial Debts (Interest) Act 1998, plus reasonable debt‑recovery costs.
7. Data Protection & Privacy
7.1 The Company processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR)and the Data Protection Act 2018.
7.2 Data collected may include booking details, medical declarations, training records, patient report forms, and imagery.
7.3 Purposes of processing include the administration of Services, certification, clinical governance, legal compliance, and—where consent has been given—marketing communications.
7.4 Personal data are retained only for as long as necessary (e.g., training records for seven years; patient records for ten years).
7.5 Individuals have the right to access, rectify, erase, restrict, or object to processing of their data. Requests should be sent to info@reactivemedical.co.uk.
7.6 Data are stored securely using encryption and access controls. Third‑party processors (e.g., awarding bodies) are engaged under written contracts that meet UK GDPR standards.
8. Photography & Media
8.1 The Company may capture photographs or video during Services for training, quality assurance, and promotional use.
8.2 By attending, the Client and participants grant the Company royalty‑free rights to use such media. Anyone wishing to opt out must inform the Company in writing before the Service begins.
9. Clinical Governance & Quality Assurance
9.1 All clinical activities are overseen by the Company’s Clinical Governance Lead, ensuring adherence to current guidelines from Resuscitation Council UK, Faculty of Pre‑Hospital Care, and JRCALC.
9.2 Regular internal audits, scenario reviews, and staff Continuing Professional Development (CPD) are undertaken to maintain high standards.
9.3 Where guidelines are updated, the Company will implement changes within a reasonable timeframe.
9.4 Clients agree that Company staff are the clinical decision‑makers on scene; their professional judgement is final.
10. Liability & Client Responsibilities
10.1 The Client is responsible for providing a safe working environment, clear access/egress for emergency vehicles, and accurate event information.
10.2 The Company’s liability for any claim shall not exceed the value of the fee paid for the relevant Service, except in cases of death or personal injury caused by the Company’s negligence.
10.3 The Company is not liable for loss or damage arising from:
• false or incomplete information supplied by the Client;
• acts or omissions of third parties;
• participant misuse of taught skills outside a controlled environment.
11. Complaints
11.1 Complaints should be made in writing within 14 days of the incident to info@reactivemedical.co.uk.
11.2 The Company will acknowledge receipt within five working days and provide a written response within 28 days following investigation.
12. Force Majeure
12.1 The Company shall not be liable for delay or failure to perform owing to events beyond its reasonable control, including but not limited to extreme weather, pandemic, industrial disputes, or acts of terrorism.
13. Governing Law & Jurisdiction
13.1 These Terms are governed by the laws of England and Wales.
13.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising under or in connection with these Terms.
14. Amendment & Review
14.1 The Company may amend these Terms from time to time. The latest version will be published at www.reactivemedical.co.uk/terms and will supersede all previous versions.
14.2 Continued engagement with the Company constitutes acceptance of any revised Terms.
